1. Limitations of Use

In plain language: Use Elstori in good faith. Don't try to break it, copy it, spam through it,
or harm other users.

By using this website, you agree that you will not:

Modify, copy, prepare derivative works of, decompile, or reverse engineer any
materials and software contained on this website.

Remove any copyright or other proprietary notations from any materials and software on this website.

Transfer the materials to another person or "mirror" the materials on any other server.

Knowingly or negligently use this website or any of its associated services in a way that
abuses or disrupts our networks or any other service Elstori, Inc. provides.

Use this website or its associated services to transmit or publish any harassing,
indecent, obscene, fraudulent, or unlawful material.

Use this website or its associated services in violation of any applicable laws or regulations
Use this website in conjunction with sending unauthorized advertising or spam.

Harvest, collect, or gather user data without the user's consent.

Use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

2. Intellectual Property

In plain language: Elstori's content belongs to us. You're welcome to use the app,
but you can't copy or redistribute our materials.

The intellectual property in the materials contained in this website are owned by or licensed to Elstori, Inc. and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Elstori, Inc. at any time.

3. User-Generated Content

In plain language: What you create is yours. We never claim ownership of your content. We just need a license to display it within the app, which you can revoke by deleting your content or account.

You retain your intellectual property ownership rights over content you submit to us for publication on our website. We will never claim ownership of your content, but we do require a license from you in order to use it.

When you use our website or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account.

4. SMS/MMS Communications

In plain language: We'll only ever text you if you've opted in. You'll receive no more than
12 messages per month. You can stop them at any time by replying STOP.

Elstori, Inc. may send SMS and/or MMS communications for conversational and
informational purposes, but only with your prior express consent.

Opting in: When you opt in to receive SMS/MMS communications, you expressly consent to receiving messages for the purposes described above. Standard message and data rates may apply.

Frequency: You will receive no more than 12 SMS/MMS messages per month.

Opting out: Reply STOP or UNSUBSCRIBE to any message at any time to stop receiving communications.

5. Nature of Service — Not Medical Advice

In plain language: Elstori is a support tool, not a therapist, doctor, or crisis service. Everything in the app is for informational and self-reflection purposes. If you are in crisis, please reach out to a professional immediately.

Elstori provides AI-powered emotional support tools for parents. Elstori is not a licensed therapist, medical provider, psychiatrist, or crisis counselor. It does not diagnose, treat, cure, or
prevent any medical or mental health condition.

The content provided by Elstori- including AI-generated chat responses, mood journal insights, and personalized recommendations, is for informational and self-reflection purposes only and should not be considered a substitute for professional medical advice, diagnosis,
or treatment.

If you are experiencing a mental health crisis or emergency, please contact a qualified professional
immediately or call the 988 Suicide & Crisis Lifeline by dialing or texting 988.

6. Age Requirement

In plain language: You must be 18 or older to use Elstori. No exceptions.

You must be at least 18 years of age to create an account or use Elstori. By using the Service, you represent and warrant that you are 18 or older. Elstori does not knowingly collect personal information from individuals under 18, in compliance with the Children's Online Privacy Protection Act (COPPA).

7. AI-Generated Content

In plain language: Elstori uses AI to generate responses and insights. AI is powerful but not perfect; please don't treat anything it says as professional advice. Always use your own judgment and consult a professional
when it matters.

Portions of the Service use artificial intelligence models (including those provided by Gemini and Google) to generate responses, insights, and recommendations. AI-generated content may be inaccurate, incomplete, or inappropriate. You acknowledge that:

8. Health & Wellness Data

In plain language: The personal health information you share — your moods, journal entries, intake responses — is treated as protected health information. We never share it with third parties for marketing. Ever.

Elstori collects self-reported health and wellness information, including mood entries, journal reflections, and intake responses, to personalize your experience. This data is classified as protected health information under the California Confidential Medical Information Act (CMIA).

We will not share your health and wellness data with third parties for marketing purposes. For full details on how we handle this data, please see our Privacy Policy.

9. Voice Data & Transcription

In plain language: If you use voice features, your audio is sent to a transcription service (ElevenLabs) to convert it to text. It's not stored. It's not used to identify you. It goes away after transcription.

Elstori offers optional voice input features. When you use voice features, your audio is transmitted to ElevenLabs solely for the purpose of converting speech to text. Voice data is used for transcription only and is not used for biometric identification. Audio recordings are not stored after transcription is complete. This disclosure is provided in compliance with the Illinois Biometric Information Privacy Act (BIPA).

10. Community Features & User Conduct

In plain language: Our community is a safe space for moms supporting each other. Treat everyone with the kindness and empathy you'd want for yourself. Harmful, harassing, or discriminatory
behavior will result in account suspension.

Elstori includes community features such as Circles (group chat) and direct messaging. You agree to:

Treat other members with respect and empathy
Not share medical advice or present yourself as a licensed professional Not post content that is harassing, discriminatory, or harmful
Not solicit other users for commercial purposes
Not share other members' personal information outside the platform.

Elstori reserves the right to remove content or suspend accounts that violate these guidelines.

11. Informed Consent

In plain language: Before you use our AI features, we'll ask you to confirm that you understand what
they are and what they aren't. Your consent is logged so we have a record of it.

Before accessing AI-powered features, you will be asked to acknowledge that you understand the nature and limitations of the Service. By providing this acknowledgment, you consent to the use of AI tools as described in these Terms. Your consent is logged with a timestamp for
record-keeping purposes.

12. Astrology & Playbook Features

In plain language: Our Playbook feature is for entertainment and self-reflection only. Astrological readings are not medical, psychological, or scientific assessments. They're a fun, meaningful way to understand yourself and your baby, not a basis for medical decisions.

13. Liability

In plain language: We've built Elstori with care and intention, but we can't guarantee it will be perfect all the time. We're not liable for decisions made based on content in the app. Please always use your own judgment and consult a professional when it matters.

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Elstori, Inc. makes no warranties, expressed or implied. In no event shall Elstori, Inc. or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website.

To the maximum extent permitted by law, Elstori and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to emotional distress, reliance on AI-generated content, or interactions with other community members.

14. Accuracy of Materials

In plain language: We work hard to keep Elstori's content accurate and helpful. But we can't guarantee that everything is always perfectly up to date. Always verify important health information with a professional.

The materials appearing on our website are for general information purposes only. Elstori, Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website.

15. Links

In plain language: Sometimes we link to other websites. We're not responsible for what's on
those sites; always use your own judgment when visiting external links.

Elstori, Inc. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval or control by Elstori, Inc. of the site.

16. Data Deletion & Account Termination

In plain language: You can delete your account and all your data at any time through Settings.
We'll remove everything within 30 days.

You may request deletion of your account and associated data at any time through the Settings page. Upon account deletion, we will remove your personal data, chat history, journal entries, and profile information within 30 days, except where retention is required by law.

17. Right to Terminate

In plain language: If you violate these terms, we reserve the right to suspend or terminate
your account. We'll let you know in writing if that happens.

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

18. Severance

In plain language: If any part of these terms turns out to be unenforceable, the rest of
the terms still stand.

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

19. Governing Law

In plain language: These terms are governed by United States law.

These Terms of Service are governed by and construed in accordance with the laws of the United States. You irrevocably submit to the exclusive jurisdiction of the courts in that
State or location.

20. Changes to These Terms

Continuing to use Elstori after changes means you accept the updated terms.

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms within the app. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
